Which title deed types exist in Turkey?

Almost all residential title deeds in Turkey are freehold which means that you have full ownership and possession rights on the property and you can inherit, sell, or rent it at any time.

Some coastal land plots in Turkey are leasehold and usually, the lease time is 49 years (subject to renewal). These land plots are often used for touristic constructions such as resorts and hotels.

Do I necessarily have to be in Turkey to complete the purchase process of a property?

If for any circumstance you cannot be present during the title deed transfer process you can give a Power of Attorney to us, or to an independent lawyer in order to complete the procedures. Upon completion of the process, your title deed will be sent to you by courier.

What are the steps of the property acquisition process?

  1. Identify the property you want to purchase from the list provided to you by TAY Property Investment according to your budget and desired criteria
  2. TAY Property Investment team checks the registry details of the property together with the seller or the seller’s representative at the Directorate of Land Registry.
  3. An appraisal report that shows the actual value of the property is issued by a company authorized for property appraisal.
  4. You or your appointed representative with a POA applies to the Land Registry Directorate with the documents required to start the sales procedures of the property.
  5. The document is checked by the Directorate of Land Registry, and The parties are informed about the fees they are to pay for the transaction.
  6. Deposit the fees. Pay the cost of the property to the seller. Payment can be made via wire transfer to make it more secure. In that case, the contract price deposited to the recipient’s account shall be blocked and it shall be transferred to the seller’s account after the contract is signed.
  7. Sign the official contract issued by the Directorate of Land Registry for the sale, under the presence of a public officer, and the sales transaction will be completed when the contract is signed.

Which documents are required for property acquisition?

  1. The property’s Title Deed or details of village/quarter, section, parcel, building, independent unit,
  2. Identity card(İF YOU HAVE A Turkish residency permit) or passport (together with the translated copy thereof where required). Submission of the same is compulsory in order to identify the nationality of the foreigner,
  3. Property appraisal report issued by any of the organizations authorized by the Board of Capital Markets (SPK) for property assessment at http://www.spk.gov.tr/SiteApps/SirketIletisim/List/gds) .
  4. ”Real Estate Market Value Document” of the property from the related Municipality,
  5. Compulsory earthquake insurance policy for buildings (residences, workplaces… etc.),
  6. One photograph of the seller and two photographs of the buyer (taken in the last 6 months, at a size of 6×4),
  7. Certified interpreter if there is a party who fails to speak Turkish,
  8. If an action is to be carried out with a power of attorney issued abroad, the translation and the original or approved copy of the power of attorney.

How long does the title deed process take?

The title deed transfer process of a turnkey property (or land) is usually between 2 to 5 working days.

Can I open a bank account in Turkey?

You can open a bank account in a bank in Turkey. Having a Turkish bank account can make your life much easier to get credit, make money transfer, and give automatic payment orders for your utility bills.

In order to open a bank account you will need to provide these documents:

Your original passport,

Notarized passport translation,

Any utility bill showing your original home address from your own country,

Your Turkish TAX Number.

Going to the Tax Office with a notarized translation of your passport (along with the original) you are easily able to get a Turkish Tax Number.
